Terms and Conditions

The use of the Hasbani UK site, offices, showrooms and exhibitions are governed by the below Terms and Conditions and by making a purchase, this indicates your acceptance of these terms and conditions. 

HasbaniUk is owned and operated by M&L Gold Limited, a private limited company registered in England.

Prices
All prices displayed are shown in GB Sterling and are exclusive of Value Added Tax. Postage, packing and insurance is displayed and charged accordingly. Hasbani UK reserves the right to change the advertised price at any time.

We are committed to protecting your privacy.

We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).

We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service.

Payment
For your convenience, we offer the following payment methods:

  All major Credit cards: Use your VISA, DELTA, ELECTRON,JCB, MAESTRO, MASTERCARD, SOLO AND SWITCH. CASH IN PERSON, WIRE TRANSFER IN EUROS US DOLLARS AND POUND STERLING.

Payment and Collection

(a) Unless otherwise agreed in advance, payment of the Purchase Price is due in pounds sterling immediately after the sale (the "Payment Date").

(b) Title will not pass to the Buyer until HASBANI UK has received the Purchase Price in cleared funds. HASBANI UK will generally not release the item to a Buyer before payment. Earlier release shall not affect passing of title or the Buyer's obligation to pay the Purchase Price, as above.

Remedies for non-payment

Without prejudice to any rights that the Seller may have, if the Buyer without prior agreement fails to make payment for the goods within 7 working days of the sale, HASBANI UK may in its sole discretion exercise 1 or more of the following remedies:-

(a) store the goods at its premises or elsewhere at the Buyer’s sole risk and expense;

(b) cancel the sale of goods;

(c) set off any amounts owed to the Buyer by HASBANI UK against any amounts owed to HASBANI UK by the Buyer for the goods;

(d) reject future or current orders from the Buyer;

(e) charge interest at 5% per annum above UK Base Rate from the Payment Date to the date that the Purchase Price is received in cleared funds;

(f) re-sell the goods by auction or privately, with estimates and reserves at HASBANI UK’s discretion, in which case the Buyer will be liable for any shortfall between the original Purchase Price and the amount achieved on re-sale, including all costs incurred in such re-sale;

(g) Exercise a lien over any Buyer’s Property in HASBANI UK’s possession and / or Buyer’s possession, applying the sale proceeds to any amounts owed by the Buyer to HASBANI UK. HASBANI UK shall give the Buyer 7 days written notice or statement of account before exercising such lien;

(h) commence legal proceedings to recover the Purchase Price for the goods, plus interest and legal costs;

(i) reverse all discounts given

(j) disclose the Buyer’s details for none payments to companies requesting reference

Hasbani UK reserves the right to refuse service to any customer or require verification information from the card-issuer prior to dispatch of the goods. All suspected fraudulent activities will be reported to the authorities.

Orders
Goods manufactured or any process is to be applied to the goods by Hasbani UK, in accordance with a specification submitted by the customer. The customer shall indemnify Hasbani UK against all loss, damages, cost and expenses awarded against or incurred by Hasbani UK in connection with or paid, or agreed to be paid by Hasbani UK in settlement of any claim for infringement of any patent, copyright, design, trade mark or other industrial or intellectual property rights of any other person which results from Hasbani UK use of the customer’s specification.

Delivery
We aim to deliver all goods in stock within 1-2 working days, unless an item is out of stock. If an item is not in stock or in the case of a special order, we normally have an average delivery lead time of 3 weeks. Any dates quoted for delivery of the goods and/or the supplies of services are approximate only, and Hasbani UK shall not be liable for any delay in delivery or supply however caused.

All packing and handling of goods is at the Buyer's risk. Hasbani UK will not be liable for any acts or omissions of third party packers or shippers.

Returns
We are confident that you will be delighted with your purchase. If, for any reason, you are not satisfied with your order, or you order is faulty you must report it immediately and return it for an exchange or refund within 7 days of receiving your purchase. Return the item un-used in its original condition and packaging by registered post to our address, with a reason for the refund or exchange. Only at Hasbaniuk’s discretion would special orders be accepted for returns and refund.

IMPORTANT: When returning your item, you are responsible for insuring the package for the full purchase price. We recommend that you return your item by Royal Mail Special Delivery, which includes insurance. If you do not insure the package and keep a receipt of insurance you will be held responsible should any loss or damage occur.

Damaged goods
If any item is delivered faulty or broken, and is rejected it must be returned to us within 7 days, along with full details of the order and the invoice number and date. Each piece must be in it's original packaging (where possible) with the product code clearly stated.

Items will only be credited or replaced if the damage occurred prior to delivery, or if it is clear that the problem is due to a manufacturing fault. Items appearing to have been damaged due to wear and tear or mistreated in any way cannot be guaranteed for a refund or a replacement. Credit notes and replacements are issued at Hasbaniuk's discretion.

Complaints
If you have a complaint to make please email us at complaints@hasbaniUK.com. We endeavour to respond to complaints within 5 working days.

We treat all complaints seriously and will try to resolve the issue immediately, if this is not possible we will give you a time scale. If the problem is not resolved to your satisfaction we would be happy for it to be reviewed by a recognised arbitration body.

We have endeavoured to ensure that all descriptions of size, weight, style, dimensions etc. are correct.

Force Majeure
We will not be liable for non-performances of our obligations caused or resulting from (but not limited to) acts of God, acts of war, civil commotion, riots, flood, drought, fire, industrial disputes and legislation. If by reason of such circumstances it shall become impossible within a reasonable time for the company to wholly or partly supply the items ordered then the customer's liability will be limited to the value of the items already supplied together with any associated delivery charges.

These terms and conditions shall be governed by and construed in accordance with the laws of England, whose Courts shall have exclusive jurisdiction.

These terms and conditions do not affect your statutory rights.
